Union Contributions

Of the total accrued from the union contribution, 60% remains with the union itself - even if the contributing company is not associated to a union - whilst the Ministry of Labor receives 20% and the Federation of Industries of the respective State, 15%. 5% of the total remains with CNI. While there is no Union in place, the federation receives 60%, the Ministry of Labor 20% and CNI 20%.
The union contribution is foreseen under the terms of Articles 578 and 591 of the Consolidated Labor Laws (CLT). Being a tribute, it is levied compulsorily on employers every January the year and on workers in April. The article 8, IV, in fine, of the Brazilian Constitution determines this annual on all those involved.
It is duty of the Ministry of Labor to issue procedures concerning the gathering of the union contribution and manner of its distribution.
This form of contribution is calculated on the basis of the company's social capital and is divided into categories.
